This comlaint is regarding money refund from Chd Builder. Chd has collected 250000/- for prelaunch single bhk unit of 630 sqft area in project "Chd Resortico" Sohna in 2013 . Chd collected money for this project without complete approvals of goverment authorities and also we came to know that prelaunch without complete approvals is illegal in india. That all clearances are compulsory before launching a project.

The buyers were made to invest their hardcore money saved in bits in a pre-launching project which didn’t have relevant approvals earlier and selling these apartments of project beforehand by CHD, was banned by DIRECTORATE OF TOWN & COUNTRY PLANNING, HARYANA.

Dealers and Builder both sold this project as a residential project But now it is being told by Chd that project is a commercial area project.

Now this commercial project is affecting and increasing all this charges i.e. parking charges, PLC, Electricity, Water etc. And area of unit also has been increased. So I have applied for a refund in June 2015. I called and visited CHD lots of times but not getting any satisfactory confirmation on refund amount. CHd is not returning my money. Builder is harassing and torturing me for refund of my hard earnest money.

I have called many times to Chd and also visited to CHd delhi office to know the status for the same. But not getting any satisfactory result. Also sent mails as a reminder to chd management on this but not getting reply from them. So i am taking this initial action thru this forum.

When buyer is not interested, it is a breach of trust, harassment and mental agony for not refunding his deposit. According to above said things my money should be refunded on immediately basis. I need support of your forum to get refund of my hard earnest money.

Demand of Additional Amount due to Arbitrary increase in cost of plot

I was allotted a plot in 2009 by Yamuna Expressway Authority, Greater Noida. The additional and arbitrary demand has given me a rude shock. In this connection, I have the following points to emphasise: 1. I have already made full one time payment towards the cost of the plot by raising Bank loan and provisional lease deed has already been registered in my favour in early 2010. 2. I have also paid full one time lease rent at the time of registering the property in my favour. 3. At no point of time i.e., at the time of placing advertisement in newspapers, in the brochure, in the allotment letter, or in the registered lease deed, the Authority mentioned that any demand of additional compensation to the farmers was likely to be made. 4. The Authority has already received full payment of the plot as well as lease rent in 2010 the interest of which alone far exceeds the payment demanded by them as no possession has been handed over till date. 5. As per YEA Authority's own website and information, my plot is not under any litigation. 6. As per information gathered from other allottees, not everyone has received the demand then why this policy of pick and choose. On top of this, the Authority asks us to surrender the plot for which I have already paid so much interest and instalments to the Bank. In view of this, Authority's demand for additional and arbitrary amount is unjustified and unwarranted. Like me there are thousands of other allotees who might have felt the pinch. Has any body taken up the matter with the Authority?If not, Let us make a joint move to challenge this illegal demand. Delay in flat possession by more than double the committed time

I applied to CGEWHO (Central Government Employees Welfare Housing Organization) Mohali Ph-1 flats thinking it would be a safe bet and paid first installment in first quarter of 2007. As per brochure construction was supposed to complete in approximately 30 months but it is almost more than 60 months (5 years) and still no signs of possession, construction is under way at a snail's pace. They also increased the price of flats by 25% from the price mentioned in the brochure reason being increase in construction costs, but the delay is from there side and construction cost will keep on increasing with every passing year. CGEWHO previously gave unsatisfied customers the option to withdraw from the scheme, but interst rate they offered was much lesser than the home loan rate I am paying. As an end user what options do I have apart for waiting for possession.

Non Delivery of Flat in Time

This has reference to my various discussion with reference to booking in PAL Group Project PAL Garden, Sector 89, Faridabad and our various telecon. I am booked against flat no. G-1603. This email is being written after huge disappointment because of delays by PAL Group in execution of the project. The facts related to my booking is being reproduced for your reference. 1. First payment for an amount of Rs 170000/- and Rs 105000/- was done on 29.12.2006 2. Second payment for an amount of Rs 229000/- was done on 03.03.2007. 3. Housing Loan was sanctioned by LICHFL on 19/11/2007 and further on expiry due to non starting of work by M/S PAL on 23/06/2008. 4. Flat Buyer's Agreement was executed on 20.05.2008 As per agreement, the flat was scheduled to be delivered within 36 months of agreement i.e. by 19.05.2011. However, till date the flat delivery is not yet done. The matter of fact is that I had got loan sanctioned twice from LICHFL and had to pay application fees twice. However, loan was not disbursed by LICHFL due to reasons attributed to M/S Pal Group. These delays are attributed to M/S PAL Group. An amount of Rs. 504000/- is blocked since last four years, which if invested in other sources of investment/banks etc would have earned me huge returns/bank interests. Due to delays attributed to M/S PAL Group, I have booked another flat, for which Loan is already sanctioned and the project is in advanced stages.

ihad booked two plots in 2007, but company fail to provide me by oct 10,but as per agreement he supposed to pay me interest with base amount. now he refuse to pay interest but base amount has been return.

I booked a 3 bhk flat in Bestech Park View Ananda, sector-81 Gurgaon, approx price of Rs. 80 Lacs, from AGNI Properties (Agent, Sunny Sahani). He introduced the project as a new launch @ Rs.4,250 psf, and informed that there will be a discount of Rs.250 psf from the company when the project is launched in the market. I issued the cheque of Rs. 6 Lacs in Nov. 2010, and he informed that he will deposit it with my consent when the booking opens (I issued the cheque and after that the agent never came to fill up the application form for the flat, and now I suspect that probably he had forged my signatures.) The cheque remained with him for 1 month. Later at the time of presenting the cheque he informed that the company Bestech had negotiated with Agni Properties their commission, and a discount of 4 % on Rs 4250 psf will be forwarded to me at the time of paying 2 nd installment of the flat. My cheque was encashed and a receipt was issued by Bestech Group in Jan. 2011. In the meantime he also informed that the company had raised the price to Rs. 4500 psf, and I asked him about the selling option, to which he reminded of the 1 year lock-in period. The company informed me of the allotment through a letter, wherein the BSP was Rs. 4,250, I immediately contacted Sunny and asked him to get the discount adjusted in the letter of allotment itself. He, however, told me that it will be adjusted at the time of execution of agreement with the Company which is at the time of payment of 2nd installment. In March 2011, I received the demand letter from the Company, and started arranging the funds, I made a part payment of Rs. 5 Lacs in May 2011. I tried contacting Sunny just to ensure that the discount will be forwarded this time. After much calls, at a very later stage, I came to know that he had left Agni Properties. I enquired in the market about the ongoing price and came to know that the project was launched much earlier at a price of Rs. 4000 psf, and there was not any demand for this project in the market. I approached Customer services, Bestech for refund of my money, who told me that they need time to resolve the issue and gave me the contact no. of P.K. Sharma ( AVP- Business Development ) of Agni Properties, and told me three of us should have a meeting and resolve the issue. Both Mr P.K. Sharma and Customer Service, Bestech kept on prolonging the issue for 2 months on some pretext with assurances of resolving my issue. The meeting never happened. Finally P.K. Sharma informed that the issue will be resolved when Agni Properties issues an NOC to Bestech that they will not claim any commission on my flat. The NOC never got issued and last week P.K. Sharma resigned. The Customer Services person arranged a meeting with a senior person of the Bestech Group on 9th August, 2011. In the meeting we were told that there were few other similar instances with Agni Properties in the same project and Bestech’s management had come with these options for the affected buyers:- 1. Either to sell in the market Or 2. Surrender the flat to the company, so that the company will sell it and refund our money subject to deduction of Rs.50,000+ service tax towards admin and interest charges. He however, mentioned that the Company will not mention this in writing and I will have to submit all the original documents, also there is no time frame within which the company commits to sell the flat. It was just an internal policy of the Company. . He gave me 4-5 days to think over and revert.
