Booking form documents forged by Supertech and now not giving cancellation amount

Hi, As discussed please find little synopsis of our property case that is in consumer court right now. Need your advice on the same. • Project – Supertech Capetown • Builder – Supertech • Property Dealer – JKM • Booking Date – 20.11.2011 Flat booking details: 1. Booking Area – 1150 sqft 2. BSP – 3217/- (This was forged by either Supertech/JKM and changed to INR 3420/-)(We were not aware of the changed booking document with our faked signature that are in supertech file) Concern: We had booked the above mentioned flat with Supertech Capetown project through property dealer JKM by paying 10% of booking amount i.e. INR 3,75,705/-. (BSP -3217/-)* After 15-20 days we got a letter from supertech stating we need to make additional payment as we have not paid 10% of BSP hence we cannot get buyer seller agreement On contacting JKM we did not get any satisfactory answer so we went to Supertech office to check the case and found that our booking form has be changed and there was some other booking form in our name with changed cost of flat (i.e. BSP – 3420.01/-had been changed). Supertech did not let us take the copy of the forged documents done by them. Supertech did not help us resolved the issue and did not even cancel our property so we had to go to court, and have filed a case against Supertech to pay us back our booking amount along with interest. Now the issue is our lawyer is not taking interest in the case and has not been coming for the hearing and Supertech is pushing the court hearing with illogical responses. We are looking for getting back our booking amount of INR 3,75,705/- paid to supertech in Dec 2011. We have been going on this case for over 1 year now. *BSP – Base price of 1sqft of flat booked. Non Delivery of Flat

I had booked a 3BHK with servant quarter flat initially in Pal Group's project in sector 78, Faridabad in the year 2006. Later the company informed that they are not building 3BHK+ SQ, hence, the booking was changed to 3BHK. Again, sometimes afterwards, they said that Sector 78 would take some time to take shape and hence we were shifted to 3BHK in sector 89, Faridabad. Initially, I was offered booking in K tower of Pal garden, sector 89, Faridabad. Later, they said that they K tower will take longer time and I was shifted to J tower. When the PAWA (Pal Allottees Welfare Association) was formed we were assured that now the construction would be in top gear, and it was assured that the project would be handed over in Sept. 2011, but after extracting sizable amount from me, the construction is stand still now for the past one year. Yet, the Company raised a demand of another instalment on the pretext of enhanced EDC which had been raised by Haryana Government. According to the DTCP, Haryana website, the license of the Company already stands expired on 01.07.2010. Yet, the Company collected instalments from the flat buyers after that. I had written to Pal Infrastructure & developers Pvt. Ltd. for certain clarifications and to provide me with a copy each of all Govt. approvals, sanctions, copy of title deeds and EDC as demanded by Haryana Govt. but they have not replied. Though, PAWA used to call General Body Meetings to collect the instalments from the flat buyers on Company's behalf, now, even PAWA is not ready to reply to my mails and all the time, PAWA is speaking the language of builder. I am apprehensive that PAWA is creation of Pal Group only, only to extract more amount from the flat buyers. I also requested for refund which has been refused. At the instance of PAWA, I had made so much payment which otherwise could have been avoided. Complaint against Emaar MGF for delay in possession and levy of undue interest

Sub :- Levy of unjustified interest & delay in possession by Emaar MGF (A-202 & E-402 , The Palm Drive, Sector 66 Gurgaon, Haryana , India ) We bought 2 properties in Emaar MGF (A-202 & E-402) and gave initial booking amount in Oct 2007. Builder promised to pay deliver the possession of project latest by Dec 2010. Based on reputation of Builder (Backed by professional Dubai Based Group like Emaar) we booked 2 flats with them in a project called, The Palm Drive, Emaar MGF, Sec -66, Gurgaon, Haryana. Then we start hearing that Emaar MGF is very unprofessional group and there officials are raided by CBI, Income Tax officers. Then we heard that there projects like Common Wealth Game are full of irregularities. Height of nuisance came when there projects are started delaying. We are sitting in Nov 2012, and as per builder commitment, the project should have been delivered by Dec 2010. Thus its already delay by almost 2 years. Also find below the trail mail and link where the current status of project is reflecting and it can be clearly seen that there is no hope of possession in the near future of atleast 1 year. For buying these flats, we took a Home Loan facility from bank and later on we found that banks are not willing to take exposure on this project and builder due to bad image and poor performance. Thus banks stopped funding and making delay in payments due to poor performance of the project. Also our all hard earned money was on stake, and listening new and new news about the project, we were too scared that we paid money in conservative manner. Builder take advantage of our innocence and imposed heavy interest on delay payment of their installments. We tried to contact customer care so many times but every time they come up with false excuses. Also we wrote to their Senior Management but the reply from their side is also pathetic and quite unprofessional. We paid too much interest on bank loans and incurring heavy losses and cannot bear more loss. After all such nuisance and delay, we decided to sell the properties but here builder is again acting like a villain and asking for interest of Rs 15 Lacs instead of paying compensation. It’s totally ridiculous. Mr Parag Raj, AGM, Customer Care Department, Emaar MGF Group philosophy is not like a customer care officer, but it seems that he wants to be like a Dictator/ Governor and gave his judgment that everything from Emaar Side is okay and in case, and customer should wait for another unknown period for possession and if Emaar feels comfortable that they would pay the compensation . Also he mentioned that compensation shall be paid as per the clauses mentioned in the agreement. But he himself doesn’t know that , there is no such clause in the agreement which bind the builder for paying compensation of this delay. He forget to Step himself in the capacity of a customer and think that what would happen, if his hard earned money is put on stake where the builder commit for delivery in 3 years and not able to deliver the project in more then 5 years Moreover, he told that as compared to booking price, there is some premium is running on the project and instead of escalating the matter to Emaar, we should shut our mouth and enjoy the premium. Also he forget that , we paid more interest than premium amount. It is same thing like doing a crime like rape and instead of punishment for wrong doing pay compensation to victim. We all are living in country like India, where due to large no. of cases in court, there are some delay in doing justice. But the culprits like these builders take undue advantage of this position . Wrong Interest Charges by SVP Builders (I) Limited

I Vinita Gupta had booked a flat in SVP Builders (I) Limited in their project – “Krishna Garden”, Raj Nagar Extension Ghaziabad with flat No P-1-501 DATED 29-DEC 2009 WITH A PAYMENT OF 15% of Total Amount i.e. Rs 2,67,600/- which I had paid in two installments i.e. Rs. 51000/- (Cheque .No 642782 drawn from Punjab National Bank dated 29-Dec-2009) and Rs. 2,16,600/- (Cheque No. – 642787 drawn from Punjab National Bank dated 31-Jan-2010) on the total purchase price of Rs. 2058000/- My booking was done under the down payment plan . I was told the maps are approved from the developing authority & the approval from bank under down payment scheme will come in 10 days . From February 2009, I am regularly contacting the executives of SVP Builders and receiving the same answer that due to some technical reason we have not received the down payment approval from bank, where as they even did not have received the sanction plan from the development authority . On various telephonic communication & correspondence with the builder the builder were charging interest on non payment of the due amount under the down payment. I have with me the sanction letter from axis bank for Rs 2000000/- Dated – 30.01.12 In the above case there is no fault on my part for which I need to pay the interest for the above flat. Kindly take necessary action against the builder.

Cheating by builder

I would like to discuss my concern with you. When I had booked flat in 2009, I considered it as one of my most sensible decision. However, the way things are shaping, I am forced to think that this decision is one of my worst decisions. I had booked a flat (Flat no 1558) and at the time of booking the flat I was told that I will be getting the flat by the end of 2011. However, last year I was told that my flat delivery will be delayed as a result I had contacted the management for a resolution. I was provided another flat (Flat no 1966, station 11) with a promise that I will be getting the flat by this year end. However, again I am told that I will not get the flat before next year end. On one hand the flat delivery is getting delayed and on the other hand interest rates are getting increased as a result I am getting sandwiched between an unending delay at and ever increasing interest rates. I want to cancel the flat and get the money back but the builder is not willing to refund the money and has stopped replying to my emails. I request you to look into my concern and do the needful asap.

Complaint against Paramount Residency Pvt. Ltd.

Respected Sir, Myself Dr. S. S. Sharma & my wife Mrs. Meenakshi Sharma entered in a written contract on 18th July 2008 with m/s Paramount Residency Pvt. Ltd. for Unit No. Nimbus 705 in Paramount Symphony, Crossing Republic, NH-24. As per the contract we paid booking amount Rs. 3,27,250 (paid vide Receipt no. 667 on 13/07/2008 & Rs. 27,81,625 paid vide Receipt No. 742 on 28/08/2008. According to the clause no. 38 the builder has to pay compensation to the allottee at the rate of Rs. 5 per square feet per month if the builder is not able to complete the flat ready for possession within 3 years of the date of contract with a three months grace period. The stipulated time to complete the constructions expired on 18 July 2011. When we visited the construction site in the first week of July 2011, we found even the towers was not completed. The company officials at the construction site told us that the construction work will be completed soon and the flat will be ready for possession within grace period. On 19 July 2011, we received a letter from the builder to take the possession . We visited the construction site & found that the construction work was going on & the tower was still not complete. On our objection that how can they offer possession of a incomplete flat when even the tower was not ready they gave strange argument that we should deposit the balance amount and get the registration of sale deed of the said flat & they will complete the flat soon. They showed no interest to pay penalty for the delay in the construction. Finally we gave our objections and made demand to get the penalty amount from the builder through the registered post dated 29/11/2011 but got no reply. Again on 02/04/2012, we send a reminder by the registered post but the company didn't paid any penalty. Instead of paying the penalty they sent a letter for the chowkidaarana charge & afterwards the society charges. In June 2012, we visited the construction site and found the flat is still not ready for possession. Lot of work has to be done by the builder in the corridors, in the flat & in the tower. We send our objections & demand for getting the penalty amount from the builder on 06 June 2012 through email. Finally in response to our letters & email company send a cheque of Rs. 3208 dated 17/03/2012 which we refused to cash as a protest. Flat is still not complete. Kindly do justice for us as we are entitled to get the penalty amount from the builders at the rate of Rs. 8500 per month from the date of default. There is a delay of 13 months till now & the amounts comes to be Rs. 1,10,500. Kindly direct the company to pay penalty amount with interest for their default and complete the flat soon so that we can take the possession. Also direct the company to withdraw their demand for chowkidaarana & society charges until they complete the flat till it is ready for possession. Builder's address- Paramount residency Pvt. Non Receipt of payback by the broker as promised at the time of booking the flat at 3Cs

I had purchased a flat at Lotus Boulevard Espacia and we were promised pay back by our broker at the time of booking. Later on the broker said that payback would be given after 50% of the payment of the flat is made and after that they said it would be adjusted in our forthcoming installments..........but all in vain..... My broker was Savn Marketing at that point of time who had booked the flat through Krishna Infratech who is the channel partner for 3Cs. Initially Krishna Infratech said that my payment has already been released to Savn Marketing but after cross checking it was found that they have not released the said payment. In addition the employees of Savn Marketing has now joined Property Guru and they are now adjusting my payment with Property Guru against their flats booked in some other venture. Now both of them are blaming each other but my money is struck........The great IRONY is that 3Cs has raised their hands that they can't do anything.......... I don't understand when 3Cs knows that their channel partner is doing that thing, why they are not taking any action....it is making me believe that they have joined their hands with their channel partners and they are also enjoying our money.. Needless to mention that Mr. Sanjay Yadav and Mr. Brijesh Bhanote, both of them are non-cooperative....I request you people to please advice me what action to be taken to get my money back. Mr. Sanjay Yadav once told me that he has cross checked it with Mr. Ajay Bhasin of Krishna INfratech and my payment has already been made to Swan Marketing / Property Guru. But during my visit to Krishna Infratech's office it was found that there are no documents available with Krishna Infratech that my payment has already been released............
